Westcoastnewsstand.com attempts to be as accurate as possible. However, it does not warrant that product descriptions or other content are accurate, complete, reliable, current, or error-free. If a product offered is not as described, your sole remedy is a refund or product substitution.

7. Orders

Each part of any order that you submit to us constitutes an offer to purchase. Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order. Westcoactnewsstand.com is only deemed to have accepted your order once the magazine(s) you ordered have been mailed.

Order Cancellation and Limitations

We reserve the right to accept, decline or cancel your order or limit the order quantity for any reason.

Payment

All billing information provided must be truthful and accurate. Providing any untruthful or inaccurate information constitutes a breach of these Terms and may result in order cancellation. We also may require additional verification or information before or after accepting any order. For orders placed with a credit card payment, payment is subject to the approval of the financial institution issuing the credit card and we shall not be liable if such financial institution refuses to accept or honor the credit card for any reason. We may require, at our option, that any order placed over certain dollar amounts receive our pre-approval.

By confirming your purchase at the end of the checkout process, (1) you agree to accept and pay for the items, including all applicable fees, charges, and taxes and (2) you authorize Westcoastnewsstand.com to share any payment information and instructions required to complete the payment transactions with its third-party payment service providers (e.g., credit card transaction processing, merchant settlement, and related services).

Refunds

ALL SALES ARE FINAL. Refunds are available only as described. While we will strive to provide returns and refunds for errors on our part, excessive or abusive refund requests will void our Refund Policy.

Promotions 

We may, in our sole discretion, create discounts and promotional codes that may be redeemed for credit in your account, or other features or benefits, subject to any additional terms that we establish on a per promotional code basis (“Promo Codes”). Promo Codes may only be used once per person. Only Promo Codes sent to you through official Westcoastnewsstand.com. communications channels are valid. You agree that Promo Codes: (i) must be used for the intended audience and purpose, and in a lawful manner; (ii) may not be duplicated, sold, or transferred in any manner, or made available to the general public (whether posted to a public forum or otherwise), unless expressly permitted by us; (iii) are limited in nature and may be disabled by us at any time for any reason without liability to us; (iv) may only be used pursuant to the specific terms that we establish for such Promo Code; (v) are not redeemable for cash; and (vi) may expire prior to your use. All promotional offers may be discontinued at any time, without prior notice, at our discretion and are only available while supplies last or for the duration noted.  Promo Codes are void where prohibited by law.

Undelivered E-mails

Westcoastnewsstand.com, its service providers and the program are not liable for delayed or undelivered emails.

8. Errors

In the event a product is listed at an incorrect price or with incorrect information, Westcoastnewsstand.com shall have the right to refuse or cancel any orders placed for such products. Westcoastnewsstand.com shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card has been charged. If your credit card has already been charged for the purchase and your order is cancelled, we shall issue a credit to your credit card account in the amount of the charge.

9. Indemnity

TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, WESTCOASTNEWSSTAND.COM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WITHOUT LIMITING THE FOREGOING, WESTCOASTNEWSSTAND.COM DISCLAIMS ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, FOR ANY MERCHANDISE OFFERED ON THE SITE YOU ACKNOWLEDGE, BY YOUR USE OF THE SITE, THAT YOUR USE IS AT YOUR SOLE RISK.

11. General

Force Majeure  Westcoastnewsstand shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including, but not limited to, acts of God, war, terrorism, riots, embargo’s, acts of civil or military authorities, fire, floods, accidents, strikes or shortages of transportation facilities, fuel, energy, labor or materials.

United States embargoed countries, or (b) to anyone on the U.S. Treasury Department’s list of Specially Designated Nationals or the U.S. Department of Commerce’s Denied Person’s List or Entity List. By using the Services or purchasing products from us, you represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties. You also will not use the Services for any purpose prohibited by U.S. law.

Entire Agreement These Terms are the final, complete and exclusive agreement of the parties with respect to the subject matter hereof and supersedes and merges all prior discussions between the parties with respect to such subject matter. You also may be subject to additional terms and conditions that may apply when you use or purchase certain other westcoastnewsstand.com products and/or services, affiliate services, third party content, or products, or third party software.
